Parker & Wenner, P.A. has extensive experience in family law, from marriage planning and divorce related issues, to step parent adoption and other domestic relations matters. The firm is committed to assisting individuals during difficult times and we understand that a variety of expertise is appropriate, whether proactive planning or zealous representation.
Prenuptial and Postnuptial agreements
The use of prenuptial and postnuptial agreements are not the exclusive province of estate planning. These types of agreements, particularly prenuptial agreements, can often alleviate problems that typically occur in the event of a divorce. Many people do not get prenuptial agreements because they believe it only increases the likelihood that their marriage will fail. However, for most people, marriage is not necessarily about assets, but about love and commitment. In some cases, a prenuptial agreement is the only responsible way to enter into a marriage.
Divorce
Asset Division
Divorce involves the division of marital assets, and in some cases non marital assets. We help you classify your assets so that they can be appropriately divided, and we aggressively advocate for a fair division of both marital and non marital assets on behalf of our clients.
Spousal Maintenance
In some cases, a divorcing spousal can be entitled to spousal maintenance. The determination of whether spousal maintenance may or may not be awarded in any particular case is a function of a variety of objective and subjective factors that require the analyses of an experienced attorney.
Child Custody
For clients with minor children, child custody is possibly the most important consideration in the dissolution process. Our attorneys are experienced and well versed in Minnesota case law involving child custody, and have practiced in various counties throughout the state to help our clients achieve the result that is in the best interests of the children.
Child Support
Child support considerations are both an important part of the dissolution process, and may include post divorce proceedings for as long as your children are minors. Ensuring the proper and legal payment of child support involves not just basic support, but costs pertaining to medical and dental insurance, unreimbursed medical and dental expenses, child care, and other considerations in some circumstances.
Child Support Collection
We help our clients understand the options that are available for the collection of unpaid child support and spousal maintenance, including pursuing and enforcing of judgments against delinquent parents. Minnesota law provides significant advantages to parents collecting support obligations. We work with our clients to develop a plan that may ultimately achieve a successful result in pursuing delinquent support obligations.
